Terms of Use
1. Introduction
These Terms of Use (the "Terms") govern your access to and use of the Pocket Guides: Settle mobile application (the "App") and the pocket-guide.co.uk website (the "Website"), both published by RISENORTHDIGITAL LTD ("we", "us", "our"), a company registered in England and Wales (company number 16485759, registered office 24 Kings Mill Lane, Settle, United Kingdom, BD24 9FD), trading as Pocket Guides.
By downloading, installing, or using the App, or by using the Website, you agree to be bound by these Terms. If you do not agree, please do not use them.
2. About the App
The App is a free local guide to Settle and the surrounding Yorkshire Dales. It includes listings of places to stay, eat and drink, shop, and find things to do, as well as walks and nature, and events. It is intended for general informational use.
3. Eligibility
You must be at least 13 years old to use the App. By using the App, you confirm that you meet this requirement. The App is intended for general audiences and is not specifically targeted at children.
4. Permission to use the App
We grant you a personal, non-exclusive, non-transferable, revocable licence to download, install, and use the App on devices you own or control, solely for your personal, non-commercial use, and in accordance with these Terms.
You may not:
- Use the App for any unlawful purpose
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer, decompile, or attempt to extract source code from the App
- Use the App in a way that disrupts or harms our services or interferes with other users
- Use automated tools (scrapers, bots) to extract data from the App or the Website
- Use any of our trademarks, logos, or branding without prior written permission
4a. User accounts
You can use the App without creating an account. If you choose to create one, you can save places, walks and events to your own personal list, submit new listings or events for moderation, claim ownership of an existing business listing, and edit listings you own.
You can create an account in one of three ways:
- Email address and a password you choose
- Sign in with Apple
- Sign in with Google
When you use Sign in with Apple or Sign in with Google, the third-party provider also has its own terms governing your use of that sign-in method. We do not control those terms and are not responsible for them.
When you create an account:
- You are responsible for keeping your sign-in credentials confidential and for any activity carried out using your account
- You agree to provide an email address that you control (including any Apple private relay address generated by Sign in with Apple)
- You agree not to create accounts using someone else's email address or to impersonate any person
- We reserve the right to suspend or terminate accounts that breach these Terms or that show signs of fraudulent or automated activity
You can sign out, change your password (via the password-reset flow, for password-based accounts), or permanently delete your account from inside the App. See section 13 for what happens when you delete your account. We do not currently charge consumers for accounts.
4b. Business features and paid services
Some features are aimed at business owners — in particular, paid listing placement and promoted events. These are paid services arranged through our Website or directly with us, and payment is handled by our payment processor Stripe. Separate commercial terms apply to those services and will be provided to you at the point of purchase. Nothing in section 4a affects those commercial terms, and nothing in those commercial terms affects your rights as an end user of the App under these Terms.
5. Content you submit
The App lets you submit several kinds of content for inclusion ("Submitted Content"): new place / listing submissions, ownership claims on existing listings, edits to listings you own, event submissions and photos attached to any of the above. When you submit any of these:
- You confirm that you have the right to submit the information you provide
- You confirm that the information is accurate and up to date to the best of your knowledge
- You grant us a non-exclusive, royalty-free, worldwide licence to display, format, translate, modify and remove your Submitted Content within the App, the Website and related Pocket Guides services
- You understand that submissions are reviewed before being published, and we may edit, refuse to publish, or remove submissions at our discretion without notice
- You agree not to submit content that is false, misleading, defamatory, infringing, offensive, sexually explicit, or that promotes hate, harassment, violence or illegal activity
We are not obliged to publish any submission you make. We are not responsible for any harm arising from inaccurate or incomplete information you provide.
5a. Listing claims
If you claim ownership of an existing business listing, you confirm that you are either the owner of that business or someone the owner has authorised to act on their behalf (such as a manager, member of staff or appointed agency). We may ask you for proof of that relationship before we transfer ownership of the listing. We may decline a claim or revoke it at any time if we have reason to believe it is not genuine. Knowingly making a false claim is a breach of these Terms and may also be unlawful.
5b. Photos
If you upload a photo, you confirm that you own it or that the rights-holder has given you permission to share it. You grant us the same licence over the photo as for other Submitted Content. We may resize, compress or crop photos for display purposes. We do not strip metadata from photos you upload — if you do not want photo location data (EXIF GPS) shared, turn off location for photos in your phone's camera settings before taking the picture.
6. Moderation
All listing, claim and event submissions are reviewed by us before they appear in the App. We aim to moderate submissions promptly but make no commitment to a specific timeframe. We may decline to publish or may remove any submission for any reason, including but not limited to:
- The submission appears to be spam, fraudulent, or commercial advertising
- The submission contains content that is unlawful, defamatory, offensive, or infringing
- The submission is a duplicate of an existing listing or event
- The submission is poorly formatted or unclear
- The submission appears to misrepresent ownership of a business
7. Accuracy of information
The App contains information about places, events, and walks compiled from a variety of sources, including the businesses themselves, tourist information services, public sources, and user submissions. We make reasonable efforts to ensure accuracy, but:
- We do not guarantee that any information in the App is accurate, complete, or up-to-date
- Opening hours, prices, contact details, and event timings change frequently — please verify with the venue or organiser before relying on them
- We do not endorse, warrant, or guarantee the quality or character of any business, walk, or event listed in the App
- Walking routes are listed for guidance only. You are responsible for your own safety, navigation, weather assessment, and equipment
8. Third-party content and links
The App contains links to third-party websites (such as venue websites, TripAdvisor pages, ticket booking systems, and the Settle-Carlisle Railway). These links are provided for convenience only.
- We do not control these third-party sites and are not responsible for their content, privacy practices, or terms
- The presence of a link does not constitute endorsement of the third party
- Any interactions you have with third-party sites are at your own risk
The App also displays information sourced from third parties, including (but not limited to) TripAdvisor, Visit Settle, the Yorkshire Dales National Park, and the businesses themselves. We use this information in good faith and credit sources where appropriate, but are not responsible for inaccuracies in third-party content.
9. Intellectual property
The App and the Website — including their names, design, branding, logos, layout, and software (excluding user-submitted content and third-party content) — are owned by Pocket Guides and are protected by copyright, trademark, and other intellectual property laws.
You may not use any of our intellectual property without our prior written permission, except as expressly allowed in these Terms.
10. Disclaimers
The App and the Website are provided "as is" and "as available". To the maximum extent permitted by law, we exclude all express or implied warranties relating to the App and the Website, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement.
We do not warrant that the App or the Website will be uninterrupted, error-free, secure, or free of harmful components.
11. Limitation of liability
To the maximum extent permitted by law, we will not be liable to you for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App or the Website, including (without limitation) loss of profit, loss of data, personal injury, or property damage, even if we have been advised of the possibility of such damages.
In any event, our total liability to you for any claim arising from your use of the App or the Website will not exceed £100.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded by law.
12. Changes to the App
We may modify, suspend, or discontinue the App, the Website, or any feature at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.
13. Termination and account deletion
We may suspend or terminate your access to the App at any time, with or without cause or notice. You may stop using the App at any time by uninstalling it from your device.
You can permanently delete your account from inside the App using the "Delete account" button on the Saved tab. Deletion runs a single irreversible process described in the Data retention section of our Privacy Policy. In summary: your account record, sign-in record, push tokens and pending photo uploads are deleted; your identifying information is removed from any listings, claims and events you submitted; and your account ID is removed from anonymised engagement records. Published listings, events and photos that already form part of those listings or events remain in the App.
14. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms or your use of the App or the Website will be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top will reflect the most recent change. Your continued use of the App or the Website after changes are posted constitutes your acceptance of the updated Terms.
